$2.5 million award in a complex litigation case

Among many successful arguments in Federal Court proceedings, the attorneys at Robertson, Johnson, Miller & Williamson secured an award in excess of $2.5 million in a complex litigation case for Nevada client Prologis in an original $370,560 extended-lease agreement dispute with Delaware-based corporation IGT, Inc. (Case No. 3:11-cv-00346-HDM-WGC; U.S. District Court of Nevada). The United States District Court of Nevada also awarded the client Prologis all attorneys’ fees and costs in the three-year litigation.

The original industrial large storage-space lease agreement was amended with an early termination clause when Prologis assumed the contract. The Delaware based corporation soon expressed its intention to exercise its option to vacate the contract early on the property in Nevada. Because the occupant did not meet its obligations before the deadline to complete the transaction, and failed to proffer the agreed upon early opt-out payment, the federal matter was heard in the U.S. District Court of Nevada.

The team at RJM&W successfully defended Prologis against the suit brought by the corporation based in Delaware as it argued for relief of its payment obligation. Our attorneys argued the case and secured the award for the multi-year rental obligations under the contract plus accrued interest and legal fees.
